1Agreement

These Terms of Use ("Terms") are an agreement between you and Starwalk (Shanghai) Network Technology Ltd ("StarWalk Technology", "we", "us") for the Tamatabi (たま旅) app and widget (the "App"). By downloading or using the App you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the App.

2Using the App

Tamatabi is a virtual pet that travels a simulated version of the real world. If you are under the age of majority where you live, please use the App with permission from a parent or guardian. You are responsible for your device, its internet connection and any data charges.

3Licence

We grant you a personal, non-exclusive, non-transferable, revocable licence to use the App on Apple devices you own or control, as permitted by the App Store's Usage Rules. All rights in the App, including its characters, artwork, text and software, belong to us or our licensors. You may not copy, modify, distribute, sell or reverse-engineer the App, or use the characters or artwork commercially, except as allowed by law.

4Coins and virtual items

• Coins, food, tickets, souvenirs and other in-app items are earned in the App (for example from steps or optional rewarded ads). They cannot be bought, and they have no monetary value.
• They cannot be exchanged for money or real goods, and cannot be transferred or sold outside the App.
• We may adjust balances, limits or items to keep the game fair, fix errors or respond to misuse. Items may be lost if you delete the App or reset your pet.

5Friends and your content

The optional Friends feature lets you share your pet's profile and send gifts and postcards. You keep ownership of the text you write (pet names, notes and postcard messages, "Your Content"). You give us a worldwide, royalty-free licence to store, process and display Your Content only as needed to run the App, including sending it to the friends you choose and to the AI providers described in our Privacy Policy.

You can block or report other players in the App. We may review reports and remove content, or limit or suspend access to the Friends feature, if we believe these Terms have been broken.

6Rules of conduct

Please do not:

• send content that is unlawful, harassing, hateful, sexual, violent, or that infringes someone else's rights;
• share personal information about yourself or others in pet names, notes or postcards;
• impersonate others, spam, or abuse the friend, gift or report systems;
• tamper with the App, use modified clients, bots or scripts, or access our servers other than through the App;
• interfere with the App's security or overload our services.

7AI-generated content and place information

Your pet's journey is a simulation. Diaries, letters, decisions and local information are generated automatically, partly by AI, and come from third-party sources such as maps, Wikipedia, OpenStreetMap and shops. This content may be inaccurate, incomplete or out of date and is provided for entertainment only.

Do not rely on the App for navigation, travel planning, transit times, weather, opening hours, events, prices or safety decisions. If you visit a place you saw in the App, follow local laws and signs, and respect private property.

8Third-party services, ads and links

The App uses third-party services (such as Apple, Google, Wikipedia, OpenStreetMap, Radio Browser and Rakuten) that are governed by their own terms. The App may show optional rewarded ads from Google AdMob. Souvenir items may link to online shops through affiliate links, marked "Ad", and we may earn a commission. Purchases you make in those shops are between you and the shop. We are not responsible for third-party websites, products, radio streams or content.

9Changes to the App

We are always improving Tamatabi. We may add, change or remove features, limits or content, and we may suspend or stop the App or its online features (with notice in the App where reasonably possible).

10Disclaimers

To the extent permitted by law, the App is provided "as is" and "as available", without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose and non-infringement. We do not guarantee that the App will be uninterrupted, error-free, or that saved data will never be lost.

11Limitation of liability

To the extent permitted by law, we are not liable for indirect, incidental, special or consequential damages, or for loss of data, virtual items or profits, arising from your use of the App. Our total liability for any claim related to the App is limited to the greater of the amount you paid us for the App in the 12 months before the claim (if any) and JPY 10,000.

Nothing in these Terms excludes or limits liability that cannot be excluded or limited by law, including liability for our wilful misconduct or gross negligence, or your rights as a consumer (for example under Japan's Consumer Contract Act).

12Termination

You can stop using the App at any time and delete your server data in the App. We may suspend or end your access if you seriously or repeatedly break these Terms. Sections that by their nature should survive termination (such as 3, 4, 10, 11 and 14) will survive.

13Apple App Store terms

• These Terms are between you and us only, not Apple. Apple is not responsible for the App or its content.
• Apple has no obligation to provide any maintenance or support for the App.
• If the App fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any). To the maximum extent permitted by law, Apple has no other warranty obligation regarding the App.
• We, not Apple, are responsible for addressing any claims relating to the App, including product liability claims, claims that the App fails to meet legal or regulatory requirements, and consumer protection claims.
• If a third party claims the App infringes their intellectual property, we, not Apple, are responsible for the investigation, defence, settlement and discharge of that claim.
• You confirm that you are not located in a country subject to a U.S. Government embargo or designated as a "terrorist supporting" country, and that you are not on any U.S. Government list of prohibited or restricted parties.
• Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

14Governing law and disputes

These Terms are governed by the laws of Japan. The Tokyo District Court has exclusive jurisdiction in the first instance over any dispute arising from these Terms or the App, without prejudice to any mandatory consumer protection laws of the country where you live.

15Changes to these Terms

We may update these Terms. We will post the new version on this page with a new date and, for material changes, notify you in the App in advance. If you continue to use the App after the changes take effect, you accept the updated Terms.

本利用規約（以下「本規約」）は、Starwalk (Shanghai) Network Technology Ltd（以下「当社」）が提供するアプリ「たま旅」およびウィジェット（以下「本アプリ」）の利用条件を定めるものです。本アプリをダウンロードまたは利用した時点で、本規約およびプライバシーポリシーに同意したものとみなします。

2ご利用にあたって

たま旅は、現実の世界をもとにしたシミュレーションの中を旅するバーチャルペットです。未成年の方は、保護者の同意を得てご利用ください。端末・通信環境・通信料はご自身の負担となります。

3使用許諾

当社は、App Store の利用規則の範囲で、ご自身が所有・管理する Apple 製端末で本アプリを利用するための、個人的・非独占的・譲渡不可・撤回可能な権利を許諾します。キャラクター、イラスト、文章、ソフトウェアを含む本アプリに関する権利は当社またはライセンサーに帰属します。法令で認められる場合を除き、複製、改変、配布、販売、リバースエンジニアリング、キャラクターやイラストの商用利用はできません。

4コイン・アイテム

• コイン、ごはん、きっぷ、おみやげなどのアプリ内アイテムは、歩数や任意のリワード広告などによりアプリ内で獲得するもので、購入することはできず、財産的価値はありません。
• 現金や商品と交換すること、アプリ外で譲渡・売買することはできません。
• 公平性の確保、不具合の修正、不正への対応のため、残高・上限・アイテムを調整することがあります。アプリの削除やペットのリセットにより失われる場合があります。

5交流機能と投稿内容

任意の「プレイヤーとの交流」機能では、ペットのプロフィールを共有し、ギフトやポストカードを送ることができます。あなたが書いた文章（ペットの名前、メモ、ポストカードのメッセージ。以下「投稿内容」）の権利はあなたに帰属します。あなたは当社に対し、本アプリの運営に必要な範囲で投稿内容を保存・処理・表示する（選んだ友だちへの送信や、プライバシーポリシー記載の AI 事業者への送信を含む）ための、無償・地域無制限の利用を許諾するものとします。

他のプレイヤーはアプリ内でブロック・通報できます。本規約に違反すると当社が判断した場合、投稿内容の削除や、交流機能の制限・停止を行うことがあります。

6禁止事項

• 法令違反、嫌がらせ、差別、性的・暴力的な内容、他人の権利を侵害する内容を送ること
• ペットの名前・メモ・ポストカードに、ご自身や他人の個人情報を書くこと
• なりすまし、スパム、友だち・ギフト・通報機能の悪用
• 本アプリの改ざん、改造クライアント・ボット・スクリプトの使用、本アプリ以外の方法でのサーバーへのアクセス
• 本アプリのセキュリティを妨げること、サーバーに過度な負荷をかけること

7AI が生成する内容・場所の情報

ペットの旅はシミュレーションです。日記、お手紙、行動、周辺情報は一部 AI により自動生成され、地図・Wikipedia・OpenStreetMap・ショップなど外部の情報源にもとづきます。これらは不正確・不完全・古い場合があり、娯楽を目的として提供されます。

道案内、旅行の計画、交通、天気、営業時間、イベント、価格、安全に関する判断には利用しないでください。アプリで見た場所を訪れる際は、現地の法令や表示に従い、私有地に立ち入らないでください。

8外部サービス・広告・リンク

本アプリは Apple、Google、Wikipedia、OpenStreetMap、Radio Browser、楽天などの外部サービスを利用しており、各サービスの規約が適用されます。本アプリでは Google AdMob による任意のリワード広告が表示される場合があります。おみやげには「広告」と表示したアフィリエイトリンクが含まれることがあり、当社が紹介料を受け取ることがあります。ショップでの購入はあなたとショップとの取引です。外部サイト、商品、ラジオ放送、コンテンツについて当社は責任を負いません。

9サービスの変更

当社は、機能・上限・コンテンツの追加、変更、削除、また本アプリやオンライン機能の一時停止・終了を行うことがあります（可能な範囲でアプリ内でお知らせします）。

10保証の否認

法令で認められる範囲で、本アプリは現状有姿で提供され、商品性、特定目的への適合性、権利非侵害を含め、明示または黙示の保証を行いません。本アプリが中断なく、誤りなく動作すること、保存データが失われないことを保証するものではありません。

11責任の制限

法令で認められる範囲で、当社は本アプリの利用に関して生じた間接的・付随的・特別・結果的損害、データ・アイテム・利益の損失について責任を負いません。本アプリに関する当社の責任の総額は、請求の前12か月間にあなたが当社に支払った金額（ある場合）または1万円のいずれか高い額を上限とします。

ただし、消費者契約法その他の法令により免除・制限できない責任（当社の故意または重過失による責任を含みます）については、この限りではありません。

12利用の停止

あなたはいつでも本アプリの利用をやめ、アプリ内でサーバーのデータを削除できます。重大または繰り返しの規約違反があった場合、当社は利用を停止することがあります。性質上存続すべき条項（第3・4・10・11・14条など）は終了後も有効です。

13Apple に関する条項

• 本規約はあなたと当社との間の契約であり、Apple は当事者ではなく、本アプリおよびその内容について責任を負いません。
• Apple は本アプリの保守・サポートを提供する義務を負いません。
• 本アプリが適用される保証に適合しない場合、あなたは Apple に通知でき、Apple は購入代金（ある場合）を返金します。法令で認められる最大限の範囲で、Apple はその他の保証義務を負いません。
• 製造物責任、法令・規制への不適合、消費者保護に関する請求など、本アプリに関する請求への対応は Apple ではなく当社が行います。
• 本アプリが第三者の知的財産権を侵害するとの主張について、調査・防御・和解・解決の責任は Apple ではなく当社が負います。
• あなたは、米国政府の禁輸対象国またはテロ支援国に指定された国に所在しないこと、米国政府の取引禁止・制限対象者リストに掲載されていないことを表明します。
• Apple およびその子会社は本規約の第三受益者であり、本規約をあなたに対して執行することができます。

14準拠法・管轄

本規約は日本法に準拠します。本規約または本アプリに関する紛争は、東京地方裁判所を第一審の専属的合意管轄裁判所とします。ただし、お住まいの国の消費者保護に関する強行法規の適用を妨げません。

15規約の変更

当社は本規約を変更することがあります。変更後の内容は日付とともに本ページに掲載し、重要な変更は事前にアプリ内でお知らせします。変更の効力発生後に本アプリを利用した場合、変更後の規約に同意したものとみなします。

2使用本应用

たま旅是一只在模拟的真实世界中旅行的虚拟宠物。如你未达到所在地的成年年龄，请在父母或监护人同意下使用。设备、网络及流量费用由你自行承担。

3许可

在 App Store 使用规则允许的范围内，我们授予你在自己拥有或控制的 Apple 设备上使用本应用的个人、非独占、不可转让、可撤销的许可。本应用的一切权利（包括角色、美术、文字和软件）归我们或我们的许可方所有。除法律允许外，你不得复制、修改、分发、出售、反向工程本应用，或将角色和美术用于商业用途。

4金币与虚拟物品

• 金币、食物、车票、纪念品等应用内物品通过应用内方式获得（例如步数或可选的激励广告），无法购买，不具有任何货币价值。
• 不能兑换现金或实物，也不能在应用外转让或出售。
• 为保证公平、修复错误或应对滥用，我们可能调整余额、上限或物品。删除应用或重置宠物可能导致物品丢失。

5社交功能与你的内容

可选的「玩家社交」功能让你可以分享宠物资料、寄送礼物和明信片。你写下的文字（宠物名字、便签和明信片留言，以下称「你的内容」）归你所有。你授予我们全球范围、免版税的许可，仅在运营本应用所需的范围内存储、处理和展示你的内容，包括发送给你选择的好友，以及隐私政策中所述的 AI 服务商。

你可以在应用内拉黑或举报其他玩家。如我们认为有人违反本条款，可能删除相关内容，或限制、暂停其使用社交功能。

6行为规范

• 不得发送违法、骚扰、仇恨、色情、暴力或侵犯他人权利的内容；
• 不得在宠物名字、便签或明信片中透露你或他人的个人信息；
• 不得冒充他人、发送垃圾信息，或滥用好友、礼物、举报功能；
• 不得篡改本应用，使用修改版客户端、机器人或脚本，或绕过本应用访问我们的服务器；
• 不得干扰本应用的安全或使服务器过载。

7AI 生成内容与地点信息

宠物的旅程是模拟的。日记、来信、行为和周边资讯部分由 AI 自动生成，并来自地图、维基百科、OpenStreetMap、商店等第三方来源，可能不准确、不完整或已过时，仅供娱乐。

请勿将本应用用于导航、旅行规划、交通时刻、天气、营业时间、活动、价格或安全相关的判断。如你前往在应用中看到的地点，请遵守当地法律和标识，尊重私人财产。

8第三方服务、广告与链接

本应用使用 Apple、Google、维基百科、OpenStreetMap、Radio Browser、乐天等第三方服务，适用其各自的条款。本应用可能展示 Google AdMob 的可选激励广告。纪念品可能附带标注「广告」的联盟推广链接，我们可能获得佣金。你在商店中的购买是你与商店之间的交易。我们不对第三方网站、商品、电台节目或内容负责。

9服务变更

我们会持续改进たま旅，可能增加、修改或移除功能、限制或内容，也可能暂停或终止本应用或其在线功能（在合理可行时于应用内提前告知）。

10免责声明

在法律允许的范围内，本应用按「现状」和「现有」提供，不作任何明示或默示的保证，包括适销性、特定用途适用性和不侵权。我们不保证本应用不中断、无错误，或保存的数据永不丢失。

11责任限制

在法律允许的范围内，我们不对因使用本应用产生的间接、附带、特殊或后果性损害，或数据、虚拟物品、利润的损失承担责任。我们对与本应用相关的任何索赔的总责任，以索赔前 12 个月内你向我们支付的金额（如有）与 1 万日元两者中较高者为限。

本条款不排除或限制依法不能排除或限制的责任（包括因我们的故意或重大过失产生的责任），也不影响你作为消费者依法享有的权利。

12终止

你可以随时停止使用本应用，并在应用内删除服务器数据。如你严重或反复违反本条款，我们可能暂停或终止你的使用。按其性质应在终止后继续有效的条款（如第 3、4、10、11、14 条）继续有效。

13Apple 相关条款

• 本条款仅是你与我们之间的协议，Apple 不是协议方，也不对本应用及其内容负责。
• Apple 没有义务为本应用提供任何维护或支持。
• 如本应用不符合任何适用的保证，你可以通知 Apple，Apple 将退还购买价款（如有）。在法律允许的最大范围内，Apple 不承担其他保证义务。
• 与本应用相关的任何索赔（包括产品责任、不符合法律法规要求以及消费者保护方面的索赔）由我们而非 Apple 负责处理。
• 如第三方主张本应用侵犯其知识产权，由我们而非 Apple 负责调查、抗辩、和解和解决。
• 你确认你不位于受美国政府禁运或被列为「支持恐怖主义」的国家，且不在美国政府禁止或限制交易的名单上。
• Apple 及其子公司是本条款的第三方受益人，有权对你执行本条款。

14适用法律与争议解决

本条款适用日本法律。因本条款或本应用产生的争议，以东京地方法院为第一审专属管辖法院，但不影响你所在国家强制性消费者保护法律的适用。

15条款变更

我们可能更新本条款。新版本将在本页面公布并注明日期；如有重大变更，我们会提前在应用内通知。变更生效后继续使用本应用，即视为你接受更新后的条款。
